Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the FitPal Trainer application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and the developer of FitPal ("FitPal," "we," "us," or "our").

2. Eligibility

FitPal is available to users of all ages. If you are under 18, you must have parental or guardian consent to use the App. Parents and guardians are responsible for supervising their children's use of the App and ensuring it is appropriate for them.

3. Account Registration

To use certain features, you must create an account using a valid email address or through a supported sign-in method. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Permitted Use

FitPal grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial fitness tracking purposes. You agree not to:

• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App for any illegal, harmful, or unauthorized purpose.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Upload malicious content, spam, or harmful material through the Community feature.
• Use automated means (bots, scrapers) to access or interact with the App.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

5. Workout & Health Features

FitPal provides fitness and health tracking tools including workout tracking, GPS route mapping, heart rate monitoring (via your device's health platform), calorie tracking, nutrition logging, body metrics calculations, and AI-powered food scanning.

FitPal is not a medical device and does not provide medical advice. The health metrics, calorie estimates, body composition calculations, and AI food analysis provided by the App are for informational and fitness tracking purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any exercise program or making dietary changes.

6. Location Services

Certain features (running, hiking) use your device's GPS to track your route in real time, including when the app is running in the background during an active workout session. You can disable location access at any time through your device settings, though this will limit GPS-dependent features.

7. AI Food Scanner

The AI Food Scanner uses artificial intelligence to analyze food images and estimate calorie content. Calorie estimates are approximations and may not be accurate for all food types, portions, or preparations. You should not rely solely on these estimates for dietary decisions. The feature is limited to 5 scans per day.

8. Community Guidelines

The Community feature allows you to share posts and comments with other users. You are solely responsible for the content you post. You agree not to post content that is:

• Abusive, harassing, threatening, defamatory, or discriminatory.
• Sexually explicit, violent, or otherwise objectionable.
• Spam, advertising, or promotional material.
• Infringing on any third party's intellectual property rights.

We reserve the right to remove any content that violates these guidelines and to suspend or terminate accounts that repeatedly violate these rules. Community posts are automatically deleted after 7 days.

9. Intellectual Property

All content, features, and functionality of the App — including design, text, graphics, audio files, logos, icons, and software — are the exclusive property of the developer of FitPal and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our written consent.

10. Third-Party Services

The App may integrate with third-party services for features such as health data syncing, authentication, and AI-powered analysis. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. GPS accuracy, heart rate readings, calorie calculations, and AI food estimates may vary and should not be relied upon for medical or critical health decisions.

12. Limitation of Liability

To the fullest extent permitted by law, the developer of FitPal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to injuries during workouts, inaccurate health data, or data loss. Our total liability shall not exceed the amount you paid to us, if any, in the 12 months preceding the claim.

13. Account Termination

You may delete your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mongolia. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Ulaanbaatar, Mongolia.
